In court documents filed November 4, Martinez detailed a precarious financial situation, noting that his acting career has stalled and he has not secured significant roles for years. He reported monthly residual income averaging just $776.34, contrasted against monthly living expenses of approximately $17,556. With his legal debt already totaling over $176,500, the actor argued that he lacks the liquidity to sustain the ongoing litigation regarding their 13-year-old son, Maceo.
The request follows a contentious nine-day hearing that concluded in late October. While Judge Shelley Kaufman dissolved a restraining order against Berry after finding insufficient evidence of physical abuse, the court did not restore the previous 50/50 custody arrangement. Instead, Martinez was granted temporary primary physical custody, and the court mandated therapeutic sessions for the mother and son. As both parties prepare for a custody review hearing later this month, the court has yet to rule on whether Berry will be held responsible for her ex-husband’s mounting legal bills.
