Investors Face September Deadline in PROCEPT BioRobotics Lawsuit

Investors who lost more than $100,000 in PROCEPT BioRobotics stock between February 2024 and February 2026 have until September 22 to file as lead plaintiffs. The class action lawsuit, currently pending in the Northern District of California, alleges the company misled shareholders regarding its inventory and sales performance.

The litigation centers on claims that PROCEPT BioRobotics and its executives failed to disclose a critical imbalance between handpiece sales and actual medical procedures. According to the complaint, U.S. sales figures consistently outpaced procedural usage since early 2023, leading to an undisclosed surplus of more than 10,000 handpiece units in the field. Plaintiffs argue this accumulation created an inevitable, sharp decline in future revenue that the company failed to communicate to the market.

This discrepancy allegedly rendered the company’s financial guidance and public statements regarding its operational health materially false. The case, filed as Operating Engineers Construction Industry and Miscellaneous Pension Fund v. PROCEPT BioRobotics Corporation, seeks to address the financial impact on those who purchased shares during the specified class period. Legal representatives from Kahn Swick & Foti, LLC are currently managing inquiries for investors looking to evaluate their options in the ongoing federal proceedings.
