The lawsuit, filed in the United States District Court for the Northern District of California under the caption Operating Engineers Construction Industry and Miscellaneous Pension Fund v. PROCEPT BioRobotics Corporation, claims the company artificially inflated its reported U.S. handpiece sales. According to the complaint, PROCEPT utilized a discount program to incentivize bulk orders that far exceeded actual clinical demand for its Aquablation therapy system. These allegedly deceptive practices masked a consistent surplus, exposing the company to undisclosed financial risks.
The discrepancy surfaced on February 25, 2026, when PROCEPT revealed that handpiece sales had materially outpaced actual procedures every quarter since early 2023.
