Democratic Lawmakers Propose Federal Ban on Corporate Medical Ownership

The proposed legislation seeks to replicate a successful Oregon state law that has already empowered physicians to reject corporate control. Lawmakers argue the current healthcare landscape is increasingly distorted by profit-driven entities, noting that over 80% of U.S. doctors are now employed by corporations or private equity firms—a sharp rise from 62% just seven years ago.

Targeting the 'Friendly Physician' Loophole

The bill directly targets the management service organizations (MSOs) that frequently sidestep existing state bans by acting as administrative intermediaries. Under the new proposal, these firms would be prohibited from controlling clinical operations, hiring decisions, or revenue targets. It also grants physicians a private right of action, allowing them to sue for damages, while authorizing the Federal Trade Commission and state attorneys general to enforce the rules. Supporters, including the Association for Independent Medicine and Social Security Works, contend that this multi-layered enforcement strategy finally provides the necessary teeth to curb industry profiteering and restore clinical autonomy to the exam room.
