Management reported a net loss of $40.7 million for the quarter, holding $237.9 million in cash and marketable securities. The decision to forgo analyst interaction was attributed to sensitive, ongoing discussions with the FDA concerning the regulatory pathway for Deramiocel, a treatment candidate for Duchenne muscular dystrophy. This omission has intensified scrutiny from investors who suffered losses during the class period, which spans from December 17, 2025, to July 26, 2026.

The pending litigation centers on allegations that Capricor executives altered their statistical analysis plan without FDA approval before resubmitting a Biologics License Application. While the company celebrated positive topline results in December 2025—driving a 370% share price surge—the narrative shifted sharply when FDA briefing documents revealed the study failed to meet primary and secondary efficacy endpoints. An advisory committee subsequently voted 9–3 against the drug's efficacy. Investors seeking to participate in the class action have until September 28, 2026, to apply for lead plaintiff status.
