Judge Tony Baumgartner imposed the 12-month suspended sentence after reviewing surveillance footage from the Tape nightclub in Mayfair. The recordings captured Brown striking music producer Abraham Diaw twice in the head with a bottle before engaging in further physical aggression. Prosecutor Heidi Stonecliffe noted that Brown initiated the violence, with his vocal coach and co-defendant, Omololu Akinlolu, assisting by restraining the victim. Akinlolu received a four-month sentence, also suspended for one year.
Despite the severity of the incident, the court cited Brown’s guilty plea to affray, his employment status, and his charitable contributions as mitigating factors. Baumgartner explicitly rejected the notion that Brown’s fame warranted leniency, emphasizing that the singer’s celebrity status provided no protection from the law. The ruling follows a strategic shift in July when Brown opted to plead guilty to affray, a move that prompted prosecutors to drop more severe charges, including attempted grievous bodily harm. Beyond the criminal proceedings, Brown faces a separate $16 million civil lawsuit filed by Diaw for injuries sustained during the altercation.
