The legal action centers on the period between February 28, 2024, and February 25, 2026. Plaintiffs allege that the company incentivized customers to purchase handpieces for its Aquablation therapy in bulk, pulling future demand forward to mask poor performance. This practice, according to the complaint, created a facade of growth while secretly destabilizing the company's long-term financial health.
Disclosures throughout 2025 and early 2026 revealed the extent of the inventory glut. Following an August 2025 earnings report that missed analyst expectations, PROCEPT shares began a sustained slide. By February 25, 2026, the stock price had fallen by $22.06, representing a decline of more than 48% from the August peak. Reed Kathrein, a partner at Hagens Berman, stated the firm is investigating whether management intentionally misled investors regarding the company's true sales trajectory and inventory oversight.
