The legal action follows a sharp stock decline triggered by news that CVS Caremark delayed a critical coverage decision until at least early 2027.

The litigation centers on whether ARS and its leadership engaged in securities fraud or unlawful business practices. Tensions peaked on June 24, 2026, when the company revealed it missed a self-imposed July 1 deadline to secure expanded insurance coverage through CVS Caremark. This failure left the product without broader coverage for the peak summer and back-to-school allergy seasons.

Market reaction was swift and severe. Following the announcement, ARS stock plummeted $2.52 per share, closing at $8.02 on June 25, 2026—a single-day drop of nearly 24%.
