The legal challenge argues that the president is attempting to unilaterally rewrite election rules for partisan gain. According to the filing, the U.S. Constitution explicitly reserves election administration for the states, leaving the president with no mandate to impose such radical changes. The Democrats assert that the order forces the U.S. Postal Service to act outside its statutory scope, effectively undermining protections for citizens who rely on absentee and mail-in ballots.
Democratic leaders, including Senate Minority Leader Chuck Schumer and House Minority Leader Hakeem Jeffries, characterized the move as a desperate effort to weaken the electorate. Parallel lawsuits have since emerged from the Campaign Legal Center and the Democracy Defenders Fund, representing groups such as the League of United Latin American Citizens.
