Legal Battle Persists After Charges Dropped in Reflecting Pool Case

A federal judge has dismissed felony charges against former Olympic athlete David Hearn, but his legal team is pushing for further accountability. Attorneys are now demanding grand jury transcripts to determine if federal prosecutors misled the panel to secure an indictment for alleged vandalism of the Lincoln Memorial Reflecting Pool.

The Department of Justice moved to drop the case against the 67-year-old Hearn after acknowledging that damage to the pool resulted from a botched renovation commissioned by Donald Trump. Attorney Norm Eisen, representing Hearn, argues that prosecutors were aware of these shoddy conditions before targeting his client. The defense is now seeking to have the case dismissed with prejudice to prevent any future prosecution.

Congressional scrutiny is also mounting. Rep. Jamie Raskin, the ranking member of the House Judiciary Committee, has pledged to investigate the origins of the prosecution, aiming to uncover who suppressed evidence and why the government pursued a case that lacked factual merit. Meanwhile, Trump continues to insist on Hearn’s guilt, citing a witness who claimed to see the athlete damaging the pool’s coating. Hearn's lawyers have dismissed these allegations as harassment, noting that they submitted photographic evidence months ago proving the damage existed well before their client reached the site.
