New York City and EmblemHealth Settle Retiree Co-Pay Suit for $53 Million

The settlement, currently awaiting approval from New York County Supreme Court Justice Lyle E. Frank, covers 100 percent of the co-pays collected between January 1, 2022, and January 31, 2023. Beyond the immediate payout, the agreement freezes the existing $15 Senior Care co-pay rate through December 31, 2027. This resolution follows a successful temporary injunction that previously blocked the fees for two years, saving the retiree community an estimated $110 million.

Legal representatives and advocacy groups describe the outcome as a significant defense of promised retirement benefits. Marianne Pizzitola, president of the NYC Organization of Public Service Retirees, emphasized that the financial relief addresses the regressive nature of healthcare costs for aging populations. Lead attorneys Jacob Gardener and Steve Cohen noted that while the settlement secures these specific funds, the broader objective remains a total elimination of co-pays for city retirees, a benefit they argue was a fundamental promise to public service workers.
