In an 11-4 vote, the Hague-based court determined that Israel’s presence in the territories is not entitled to sovereignty. The ruling cites extensive evidence that the Israeli government has systematically confiscated Palestinian land for settler use, exploited natural resources, and undermined the local population’s right to self-determination. The court specifically highlighted the failure to prevent settler violence and the destruction of property as indicators of an intent to permanently annex land and forcibly displace Palestinians.
Beyond the immediate call for evacuation of settlers, the court voted 12-3 to declare that all nations have a legal obligation not to recognize the occupation as legitimate. States are now tasked with ensuring they do not provide aid or assistance that helps maintain the current situation. While the opinion is nonbinding, experts like Nancy Okail of the Center for International Policy urged nations to respect the determination and cease the unconditional supply of arms used to perpetuate the occupation. The United States, which had previously warned the court against issuing such an opinion, now faces renewed pressure to align its foreign policy with these findings.
