Trump Ties FISA Renewal to Voter ID Bill, Cancels Clayton Hearing

President Donald Trump stalled the renewal of federal warrantless surveillance powers Wednesday, conditioning his support for the Foreign Intelligence Surveillance Act (FISA) on the passage of the SAVE America Act—Republican-led legislation mandating nationwide voter identification and proof-of-citizenship requirements that critics argue would disenfranchise millions of eligible voters.

The ultimatum, delivered via Truth Social, marks the second time Trump has obstructed the reauthorization of Section 702. This authority, which expired over the weekend, traditionally permits intelligence agencies to conduct warrantless surveillance on noncitizens abroad, though it has frequently been utilized to collect data on American citizens. Achieving the president's demand would require eliminating the Senate filibuster, a move Senate Majority Leader John Thune has already signaled lacks sufficient support within his own caucus.

Simultaneously, the political landscape surrounding the Director of National Intelligence (DNI) remains in flux. Trump announced he was canceling the confirmation hearing for his nominee, former SEC chairman Jay Clayton, despite Senate Intelligence Committee Chair Tom Cotton insisting the process would proceed as scheduled. This friction heightens the likelihood that Bill Pulte, the current acting DNI whose appointment faced intense scrutiny due to his lack of intelligence experience, will remain in the role. Many Senate Democrats, including Mark Warner, have previously withheld support for FISA extensions specifically to protest Pulte’s tenure and demand a more conventional replacement for the outgoing Tulsi Gabbard.
