A class action lawsuit filed in Orange County Superior Court accuses Empyrean Anaheim Resort, Inc. of systemic labor violations, including the denial of mandatory meal and rest periods. The complaint, brought by Blumenthal Nordrehaug Bhowmik De Blouw LLP, alleges the resort manipulated time records to avoid paying legally required penalties.

The legal filing, identified as Case No. 30-2026-01569484-CU-OE-CXC, claims that the resort’s operational practices routinely forced employees to work through breaks. Beyond missed rest periods, the litigation alleges the company failed to pay minimum and overtime wages, neglected to provide accurate itemized wage statements, and failed to reimburse workers for necessary business expenses.

According to the allegations, staff members were frequently required to work shifts exceeding five hours without the state-mandated meal breaks. The complaint further asserts that the company engaged in time-rounding practices specifically designed to circumvent penalty payments. These actions allegedly violate multiple sections of the California Labor Code, including sections 201-203, 226, 510, and 2802. The plaintiffs are seeking civil penalties for the reported conduct, citing a pattern of non-compliance with California’s wage and hour regulations.
