Investors Face October 20 Deadline in Aevex Securities Lawsuit

Investors who purchased Aevex Corp. stock during its initial public offering earlier this year have until October 20, 2026, to participate in a pending class action lawsuit. The litigation, filed in the Southern District of California, centers on allegations of concealed share-selling agreements that reportedly bypassed standard lock-up commitments.

The lawsuit, Rosenberg v. Aevex Corp., claims that the company misled shareholders regarding a 180-day lock-up period intended to restrict Madison—the firm that owned 100% of Aevex's common stock—from selling its holdings until October 2026. According to the complaint, Aevex executives allegedly arranged a secret agreement with underwriters to override this restriction shortly after the April 2026 IPO. This maneuver purportedly allowed Madison to offload shares for more than $200 million while generating over $8 million in additional fees for the underwriters.

Kahn Swick & Foti, LLC, led by former Louisiana Attorney General Charles C. Foti, Jr., is representing the class of investors who acquired Aevex stock between April 17 and June 4, 2026. While the October 20 deadline specifically concerns those seeking to be appointed as lead plaintiff, the firm notes that other investors may still be eligible to share in a potential recovery without taking on that role.
