The complaint, filed in New York, targets FuelCell Energy (NASDAQ: FCEL) for actions between June 24 and September 1, 2026. Plaintiffs allege that the company’s manufacturing output, which stagnated at an annualized rate of 37.1 MW, was insufficient to cover fixed overhead costs. This operational shortfall forced the company to record $17 million in charges related to inventory and firm purchase commitments under the project's Phase 0 agreement.
Financial results for the fiscal third quarter underscore the impact of these production difficulties. FuelCell reported a gross loss of $24.5 million on $33 million in revenue, a significant downturn compared to previous periods. Following the disclosure of these figures, FCEL shares dropped $2.68, or 15.69%, closing at $14.40 on September 2, 2026. Joseph E. Levi, representing the plaintiffs, contends that shareholders were misled regarding the company's capacity to meet its contractual obligations.
