The class-action lawsuit, Frasco v. Flo Health, Inc., centers on claims that the companies embedded software code to record sensitive in-app health communications without user consent. While Google, Flo, and Flurry maintain their innocence and deny any wrongdoing, they have agreed to the multi-million dollar payout to resolve the litigation. Google is contributing $48 million, Flo $8 million, and Flurry $3.5 million to the total fund.
Eligibility extends to those who used the Flo App in the United States between November 1, 2016, and February 28, 2019, provided they logged menstruation or pregnancy information during that window. A specific California subclass also exists for users who resided in the state during the same period. Claimants must submit their forms through the dedicated website, PeriodTrackerDataPrivacyLitigation.com, or via mail before the October 15 cutoff. The court is scheduled to review final approval of the settlements at a hearing on October 29, 2026.
