The complaint filed against Fluence (NASDAQ: FLNC) centers on claims that the company concealed operational failures between November 24, 2025, and September 16, 2026. While leadership touted a robust backlog and an automated manufacturing process for its Gridstack Pro battery solutions, the suit alleges that key facilities remained incomplete or non-operational.
Investors witnessed the fallout across three major disclosures. In February 2026, the company reported significant margin compression, followed by an August update revealing a $44.3 million quarterly net loss. By September, CEO Julian Nebreda Marquez admitted that the Houston plant was forced to rely on manual welding instead of the promised automated processes. These revelations caused the stock to plummet, resulting in a 73% decline in share price over the period. Hagens Berman, the firm leading the investigation, is now scrutinizing when management first became aware of the welding issues, with a lead plaintiff deadline set for November 27, 2026.
