The lawsuit contended that the medical team utilized excessive lateral traction during the birth, resulting in Erb’s palsy—a condition characterized by permanent nerve damage that severely restricts the function and development of the child’s right arm.

According to the Jury Verdict Reporter, the $2.5 million contribution from the hospital and the $1 million provided by the obstetrician represent the highest pre-trial recovery for such a case in the state. While the specific identities of the parties remain shielded by a confidentiality agreement, the funds are earmarked to cover long-term therapeutic needs and specialized care. Zayed emphasized that the settlement serves as a critical measure of accountability for the preventable nature of the injury, ensuring the family has the necessary resources to manage the child's lifelong disability.
