The massive award, one of the largest in U.S. history, is far from a guaranteed payday for the legal finance firm. Burford disclosed that its potential $1.4 billion recovery—split between its balance sheet and investment funds—could be significantly reduced or wiped out entirely during post-trial motions and appellate scrutiny. Historically, few patent verdicts of this magnitude survive the federal court process without being overturned or substantially settled for lower amounts.
Apple is expected to challenge the decision, potentially moving to set the verdict aside. Burford emphasized that no cash proceeds have been received and that the case remains mired in enforcement and collection risks. The firm explicitly stated that investors should not view the current figures as a final outcome, noting that the ultimate recovery, if any, will be subject to financing agreements, legal fees, and potential settlements in other jurisdictions.
