The trouble began to surface in May 2025, when Krispy Kreme announced a sudden pause in its McDonald’s deployment schedule. This reversal came just months after the company had publicly assured investors in February that the expansion remained on track. By the time the pause was announced, the number of McDonald's restaurants serving the doughnuts had stagnated at approximately 2,400, showing no growth since the February update.

Kahn Swick & Foti, led by former Louisiana Attorney General Charles C. Foti, Jr., is now examining whether officers and directors breached their fiduciary duties to shareholders. The investigation seeks to determine if the company withheld material information about the viability of the business model during the period the expansion was touted as a core growth strategy.
