The Securities and Exchange Commission established the fund after finding that Becton, Dickinson and Company failed to disclose significant regulatory and financial risks tied to the Alaris device. On February 6, 2020, the company disclosed it needed new FDA clearance for the pump and would halt sales, triggering a 12% drop in share price. While the firm settled the charges without admitting or denying the findings, it was ordered to pay a $175 million civil penalty to compensate affected shareholders.
