Singapore and Korea Forge New Legal Links for Cross-Border Disputes

The two supreme courts signed a Memorandum of Guidance (MOG) and a Memorandum of Understanding (MOU) during the 20th Conference of Chief Justices of Asia and the Pacific. The MOG provides a practical roadmap for litigants seeking to enforce monetary judgments across borders, clarifying the specific procedures required to move a ruling from one jurisdiction to the other. It excludes criminal penalties and non-monetary relief, focusing strictly on the practical recovery of funds where assets or debtors reside.

Complementing this, the MOU establishes a direct channel for the courts to share domestic laws and judicial precedents. When a case in either country requires an analysis of the other’s legal framework, judges can now access reliable interpretations and court orders more efficiently. Chief Justice Menon noted that a judgment holds little value if it cannot be enforced at the site of the debtor’s assets, and these agreements aim to replace current uncertainty with a more predictable path for international commercial resolution.
