Family Sues Mercer County Man Following Fatal Herrington Lake Collision

A family celebration on Herrington Lake turned catastrophic on July 4, 2026, when a high-speed collision left victims in the water and a boat operator fleeing the scene. Legal counsel has now filed a civil lawsuit in Mercer Circuit Court, seeking accountability for the incident that resulted in a tragic loss.

The complaint, filed by Peterson Law and Whiteford Taylor & Preston, identifies Cody Casey of Mercer County as the defendant. According to the court documents, Casey was allegedly operating a 2017 Axis watercraft at an excessive speed, performing erratic maneuvers and "donuts" near a stationary pontoon boat. Despite desperate signals from the family as the craft accelerated toward them, the collision occurred head-on.

The lawsuit asserts that Casey failed to stop or render aid following the crash, a direct violation of Kentucky law. The plaintiffs are pursuing claims of negligence, gross negligence, and failure to provide assistance, while seeking punitive damages through a jury trial. Founding partner Justin S. Peterson stated that the firm intends to hold the defendant accountable for what he described as a preventable tragedy. Masten Childers III of Whiteford Taylor & Preston echoed this commitment to seeking justice for the affected family. Legal representatives are currently soliciting testimony or visual evidence from any witnesses present on the lake that day.
