Alibaba Faces Securities Class Action Over AI Allegations and Military Ties

A securities fraud class action lawsuit has been filed against Alibaba Group Holding Limited, accusing the company of concealing links to the Chinese military and engaging in unauthorized data practices. The litigation follows a series of disclosures that triggered significant declines in the company’s share price throughout June 2026.

The case, Wistisen v. Alibaba Group Holding Limited, et al., currently pending in the Southern District of New York, alleges that executives violated the Securities Exchange Act of 1934 by misrepresenting the firm's regulatory standing. Plaintiffs claim the company failed to disclose its affiliation with the Chinese Ministry of Industry and Information Technology, a designation that classifies the entity as a Chinese military company under the National Defense Authorization Act.

Market volatility intensified following two major revelations. On June 8, 2026, the U.S. Department of Defense added Alibaba to its list of Chinese military companies, causing shares to drop 3.9%. Shortly after, reports emerged that Alibaba allegedly used thousands of fraudulent accounts to access Anthropic’s Claude AI models. These "distillation" attacks, designed to train proprietary models without authorization, resulted in a further 4.7% decline in share value. Reed Kathrein, a partner at Hagens Berman, stated the firm is investigating whether executives intentionally misled the market regarding the company’s true risk profile and competitive position. Investors who purchased securities between June 26, 2025, and June 24, 2026, have until October 5, 2026, to apply for lead plaintiff status.
