Potts Law Firm Sues xAI Over AI-Generated Child Sexual Abuse Material

A family has initiated a civil lawsuit against xAI in the U.S. District Court for the Eastern District of Arkansas, alleging that the company’s Grok chatbot facilitated the creation of sexually explicit images of their child, stemming from a broader criminal investigation into a Bentonville photographer.

The complaint, filed under Case No. 4:26-CV-750-LPR, claims that Grok’s unrestricted "Spicy" and "Unhinged" modes allowed for the generation of harmful content without adequate safety filters. According to the filing, authentic photographs of the minor were processed by the AI to produce illicit imagery. The plaintiffs are seeking damages for emotional distress and privacy violations, arguing that xAI failed to implement necessary guardrails to prevent the abuse of its technology.

The litigation is linked to an ongoing criminal probe into a Bentonville-based photographer charged with multiple felonies involving AI-generated material.
